CONFIDENTIALITY

 

Confidentiality of educational records is a basic right shared by all students and their parents.  These fundamental rights are described in the Federal Rights and Privacy Act of 1974 and as amended in 2006.  Confidentiality regulations apply to the state, all public and private schools that accept federal funds.  In addition, all school personnel (including contracted employees) are governed by the confidentiality requirements of the Individuals with Disabilities Education Act (IDEA), which applies to students with exceptionalities.  All people  involved in special education should be aware of the laws and regulations ensuring that all records records and information will be kept secure and remain confidential.

 

Confidentiality is an extremely important component in special education and one that must be understood by all staff.  Chapter 9 in the Process Handbook is very detailed and it provides a responsible way of working with confidential information.  It is important that every employee read and understand this chapter.
